A trav\u00e9s del presente nos permitimos de manera respetuosa comunicar el cierre de expediente al proceso de los vehiculos de TPC que no atendieron el llamado del sistema desde la reactivaci\u00f3n
\ndel proceso FUDO en fecha 3 de septiembre de 2023 y que no presentaron documentos para el reconocimiento econ\u00f3mico a que hab\u00eda lugar, atendiendo las disposiciones contenidas en los
\ncontratos de concesi\u00f3n para la operaci\u00f3n del sistema, espec\u00edficamente en los ap\u00e9ndice 5 y 13, as\u00ed como en el procedimiento instructivo relativo al proceso de desvinculaci\u00f3n y desintegraci\u00f3n de
\nveh\u00edculos del Transporte P\u00fablico Colectivo (TPC) con ocasi\u00f3n de la puesta en operaci\u00f3n del Sistema Integrado de Transporte Masivo (SITM) TRANSCARIBE S.A., y a las condiciones actuales
\nrespecto a la implementaci\u00f3n del sistema y las consecuencias derivadas de su no comparcencia y falta de interes en el proceso de desvinculaci\u00f3n y desintegraci\u00f3n parcial de veh\u00edculos del Transporte P\u00fablico Colectivo (TPC), as\u00ed:<\/p>\n

En cumplimiento de lo definido por los fideicomitentes (Transambiental, Transcaribe y Sotramac) en el Comit\u00e9 FUDO, en la sesi\u00f3n N\u00b0 266 de mayo de 2025, se cierra el expediente de aquellos <\/strong>veh\u00edculos cuyos propietarios no atendieron el llamado realizado de manera masiva<\/strong>. En el marco del Comit\u00e9 FUDO, se decidi\u00f3 de manera un\u00e1nime cerrar el expediente de los veh\u00edculos, al haberse configurado las preceptos que dan lugar al desistimiento t\u00e1cito conforme el C\u00f3digo General del Proceso, debido a que los propietarios no dieron cumplimiento a los requerimientos para continuar el tramite en los terminos se\u00f1alados. Esta decisi\u00f3n tambi\u00e9n se fundamenta en las consideraciones contenidas en el Ap\u00e9ndice 13 y su instructivo aclaratorio para el proceso.<\/p>\n

Dicha decisi\u00f3n se hace teniendo en consideraci\u00f3n que el Sistema Integrado de Transporte Masivo (SITM) no se implementar\u00e1 en el 100% de la ciudad, conforme a los acuerdos conciliatorios
\nsuscritos en 2023 entre Transcaribe – Transambiental y Transcaribe – Sotramac, de los cuales se deriva la no implementaci\u00f3n de la fase 3 del sistema y la no asignaci\u00f3n de nuevos recursos al
\nFondo Unificado de Desintegraci\u00f3n y Operaci\u00f3n (FUDO), recursos del fideicomiso administrados por ALIANZA FIDUCIARIA S.A.<\/p>\n

Lo anterior, atendiendo a que los veh\u00edculos fueron llamados de manera masiva el 4 de septiembre de 2023. As\u00ed mismo, mediante oficio No. TC-DO-07.01-00157-25 de 25 de enero de 2025 se reiter\u00f3 dicha convocatoria y el requerimiento a los propietarios para la presentaci\u00f3n de los documentos de los veh\u00edculos para el reconocimiento econ\u00f3mico, sin que se recibiera respuesta alguna.<\/p>\n

De acuerdo con lo dispuesto en la Cl\u00e1usula Tercera del Otros\u00ed No. 08 al Contrato de Concesi\u00f3n No. SA-MC-007 de 2014 y la Cl\u00e1usula Tercera del Otros\u00ed No. 14 al Contrato de Concesi\u00f3n No. TC LPN-004-2013, documentos contractuales que incluyeron el literal e) al numeral 3.1. del Ap\u00e9ndice 13 \u00abPROTOCOLO PARA EL PROCESO DE DESVINCULACI\u00d3N Y DESINTEGRACI\u00d3N F\u00cdSICA DE LOS VEH\u00cdCULOS DE TRANSPORTE P\u00daBLICO COLECTIVO DE CARTAGENA DE INDIAS\u00bb, se precisa que la responsabilidad sobre el cumplimiento del procedimiento en relaci\u00f3n con la aptitud del veh\u00edculo corresponde de manera exclusiva y excluyente al propietario de \u00e9ste, eximi\u00e9ndose de dicha responsabilidad a la entidad.<\/p>\n

En consecuencia, el Departamento Administrativo de Tr\u00e1nsito y Transporte (DATT) deber\u00e1 llevar a cabo la reorganizaci\u00f3n de las rutas del Transporte P\u00fablico Colectivo (TPC) actualmente adoptadas, atendiendo lo estipulado en los acuerdos conciliatorios sobre la Cl\u00e1usula 85 del Contrato de Concesi\u00f3n, en la que se dispone que \u201clas autoridades competentes podr\u00e1n incorporar al transporte y movilizaci\u00f3n de pasajeros dentro del Distrito de Cartagena, otros sistemas de transporte adicionales al Sistema Transcaribe, pudiendo el Ente Gestor y las autoridades competentes
\ndeterminar la integraci\u00f3n operacional con tales sistemas\u201d.<\/p>\n
